The terms under which TotumTeams provides its platform to organisations and their members.
1. About these terms
These Terms & Conditions ("Terms") govern your use of the TotumTeams platform (the "Service"), provided by TotumTeams ("we", "us"). By creating an account or using the Service you agree to these Terms. If you register on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
2. Use of the Service
The Service helps organisations manage groups, events, members and attendance. You are responsible for:
- the accuracy and lawfulness of the data you enter about your members;
- keeping your account credentials confidential; and
- obtaining any required consent (including guardian consent for minors) before adding members.
You must not misuse the Service, attempt to gain unauthorised access, or use it in a way that violates applicable law.
3. Accounts and access
You must provide accurate information when registering. We may suspend or terminate accounts that breach these Terms. Administrators of an organisation are responsible for managing access rights of their members within that organisation.
4. Availability and third-party services
We aim to keep the Service available but do not guarantee uninterrupted availability. The Service relies on third-party providers (for example, hosting and email delivery). We are not liable for failures caused by those third parties or by events outside our reasonable control.
5. Limitation of liability
To the maximum extent permitted by law, TotumTeams is not liable for indirect or consequential damages, loss of data, or loss of profits arising from your use of the Service. Our total liability for any claim is limited to the amount you paid for the Service in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under mandatory law.
6. Force majeure
Neither party is liable for failure to perform its obligations where that failure results from circumstances beyond its reasonable control, including but not limited to outages of third-party infrastructure, internet failures, or government measures.
7. Cooling-off and cancellation
Where you are a consumer and mandatory law provides a right of withdrawal, that right applies as set out in the applicable law. You may stop using the Service and delete your account at any time. Organisations may cancel subscriptions in accordance with the plan they selected.
8. Governing law and jurisdiction
These Terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent courts in the Netherlands, to the extent permitted by mandatory law. As a consumer you may always bring proceedings in the courts of the country where you live.
9. Changes
We may update these Terms from time to time. We will publish the updated Terms on this page with a new "last updated" date and give at least 30 days' notice before any material change takes effect, either in the Service or by email. Continued use after the effective date constitutes acceptance of the updated Terms. If you do not agree to a change, you may stop using the Service and cancel your subscription before the change takes effect.
